Public Offer Agreement for Online Store
This Public Offer Agreement (hereinafter referred to as the "Agreement") is an official offer from Cuprum Depot, located at Ukraine, Kharkiv, to any individual (hereinafter referred to as the "Buyer") to enter into a purchase agreement for goods and services on the website https://cuprumdepot.com (hereinafter referred to as the "Store"). By placing an order on the Store, the Buyer fully accepts the terms and conditions of this Agreement.
1. General Provisions
1.1. This Agreement is a public offer in accordance with the laws of Ukraine, and by purchasing from the Store, the Buyer agrees to its terms.
1.2. The Agreement governs the sale of goods and services on the Store between the Seller and the Buyer.
1.3. The Seller reserves the right to make changes to this Agreement at any time without prior notice to the Buyer. The updated version of the Agreement will be posted on the Store's website.
2. Product Information
2.1. The product range, pricing, and descriptions are available on the Store’s website.
2.2. The Seller ensures that product descriptions are as accurate as possible, but the actual product may vary slightly due to factors such as manufacturer changes.
2.3. All prices listed on the website are in Ukrainian Hryvnia (UAH) and include VAT, unless otherwise stated.
3. Ordering Process
3.1. The Buyer places an order through the Store's website by selecting a product and filling out the required order details.
3.2. The order is considered accepted by the Seller once the Buyer receives a confirmation email or SMS.
3.3. In case the ordered product is out of stock or unavailable, the Seller will notify the Buyer and may offer an alternative product or a refund.
4. Payment Terms
4.1. The Buyer can pay for the order using the payment methods available on the website, including but not limited to credit/debit cards, Apple/Google Pay, MonoPay.
4.2. Payment is considered completed when the funds are credited to the Seller’s account.
4.3. The Seller reserves the right to require full or partial prepayment for certain orders.
5. Delivery of Goods
5.1. Delivery is carried out throughout Ukraine via courier services, postal services, or by other means agreed upon between the Buyer and Seller.
5.2. The delivery cost and timeframes are calculated based on the Buyer’s location and are given to the Buyer via phone/sms/messangers.
5.3. The risk of loss or damage to goods passes to the Buyer at the moment of delivery.
6. Returns and Refunds
6.1. The Buyer has the right to return goods in accordance with the Law of Ukraine "On Protection of Consumer Rights" within 14 days of receiving the goods, provided the goods are in their original condition.
6.2. Goods of proper quality may be returned if they have not been used, damaged, or altered in any way, and if the original packaging and labels are intact.
6.3. To initiate a return, the Buyer must contact the Seller via email or phone within the specified timeframe.
7. Warranty and Liability
7.1. The warranty period for products is specified by the manufacturer and is provided in the product description on the Store’s website.
7.2. The Seller is not liable for any damage caused to the Buyer due to improper use of the goods purchased from the Store.
7.3. In case of defects or malfunctions, the Buyer is entitled to repair or replacement in accordance with the manufacturer's warranty terms.
8. Personal Data Protection
8.1. The Seller processes and stores the Buyer’s personal data in accordance with the Law of Ukraine "On Personal Data Protection".
8.2. By placing an order, the Buyer consents to the processing of their personal data for the purpose of fulfilling the order and providing customer support.
9. Dispute Resolution
9.1. All disputes arising from or related to this Agreement shall be settled through negotiations between the Seller and Buyer.
9.2. If the dispute cannot be resolved through negotiations, it shall be referred to the competent court of Ukraine, in accordance with Ukrainian law.
10. Final Provisions
10.1. This Agreement comes into effect from the moment the Buyer accepts its terms by placing an order on the Store.
10.2. The Buyer acknowledges that they have read and fully understand the terms of this Agreement before making a purchase.
10.3. In matters not covered by this Agreement, the parties shall be guided by the applicable laws of Ukraine.
